4. Approve a Motion of Support for Allocation of $263,000 in Prop K Funds to the San Francisco Municipal Railway (MUNI) for Implementation of the Inner Geary Corridor Transportation Preferential Streets (TPS) Improvement Project – ACTION* (attachment 2)

In December 2003, the Authority Board approved Resolution 04-27, allocating $105,000 in Prop B funds to MUNI to design TPS improvements for the inner Geary corridor. The Prop B allocation enabled MUNI and DPT to substantially complete engineering design for TPS improvements; conduct community outreach regarding the improvements; initiate required legislative approvals; and conduct a study of existing transit performance in the corridor that can be used as part of a before-and-after study. This project will complement Bus Rapid Transit improvements currently being studied for Geary Boulevard east of Van Ness Avenue. MUNI is requesting $263,000 in Prop K funds to implement these improvements, which include: widening existing substandard transit lanes; reducing traffic from three lanes to two lanes in peak hours; reducing the number of bus stops; adding 81 yellow and truck loading zones to reduce double parking; improving streetscape; and adding bus bulbs at three stops and lengthening two existing bus bulbs. The timing of MUNI's request is intended to take advantage of the Department of Public Works' (DPW) street resurfacing of the inner Geary corridor. Repaving of O'Farrell Street will begin in early November and will be completed before the holiday moratorium on construction. This will allow any striping changes and other TPS improvements to be implemented in coordination with the pavement resurfacing effort, resulting in cost efficiencies and minimizing disruption associated with street construction work. Pavement resurfacing on Geary Street and implementation of the TPS improvements will commence immediately after the holiday moratorium. TPS improvements for the entire inner Geary corridor are scheduled for completion by the end of March 2005. We are seeking a motion of support for allocation of $263,000 in Prop K funds to MUNI for implementation of the Inner Geary Corridor TPS Improvement Project.

5. Approve a Motion of Support to Designate Lead Agencies and Allocate up to $1,500,000 in Prop K Funds for Development of 5-Year Prioritization Programs – ACTION* (attachment 3)

Last month the CAC approved a motion of support to put $1.5 million in Prop K funds on reserve for development of 5-Year Prioritization Programs. The Prioritization Programs, which must be approved by the Authority Board, need to be developed for each of the programmatic categories in Prop K. We have identified over 20 programmatic categories including transit enhancements, new signals and signs, street resurfacing, and traffic calming. The Prioritization Programs are intended to focus project selection on performance and to support on-time, on-budget project delivery, and timely and competitive use of state and federal matching funds. The Prioritization Programs concentrate on five-years at a time, in recognition of the difficulties in predicting specific project needs beyond that horizon. The Prioritization Programs will be informed by and provide input to the Prop K Strategic Plan, which provides the 30-year road map (focusing on 10-years at a time) for Prop K allocations. Our schedule calls for Board-adoption of the Prioritization Programs by March 2005 so that they can be used to inform the FY 2005/06 annual call for projects. Recommended lead agencies for development of the Prioritization Programs are shown in Attachment 1 for all but three programmatic categories. We are finalizing discussions with project sponsors regarding designation of lead agencies for the remaining two categories, as well as allocation amounts for all of the programs. Attachment 3 provides a preview of the estimate level of effort for each programmatic category, which will be reflected in the size of the recommended allocation. We plan to bring recommendations for the specific allocation amounts to the CAC on September 22 in order to keep the schedule for completion of draft programs in December 2004. We are seeking a motion of support to designate lead agencies and allocate up to $1,500,000 in Prop K funds for development of 5-Year Prioritization Program.

6:50 Planning and Legislation

6. Review Status and Adopt Positions on Transportation-Related State Legislation – INFORMATION/ACTION

At the September CAC meeting we will provide a status report on pieces of state legislation on which the Authority has already taken positions during the current legislative session, and we will present new items as appropriate. We will provide an update on Governor Schwarzenegger's proposal to sponsor legislation that will require Bay Area voters to consider redirecting Regional Measure 2 funds (the third dollar toll) to cover the cost overruns on the Bay Bridge seismic retrofit project. The Governor's press release is included in the packet, as well as MTC's initial letter of response addressed to the Bay Area legislative delegation were included in the August CAC packet. We are seeking a motion of support to adopt positions on transportation-related state legislation, as appropriate.

7:00 Finance and Administration

7. Approve a Motion of Support for the Award of a Three-Year Contract with Two Additional One-Year Extension Options to Nossaman, Guthner, Knox and Elliott, in the Amount of $120,000 Per Year, to Provide General Legal Counsel Services, and Authorization for the Executive Director to Negotiate the Non-Monetary Terms and Conditions of the Contract – ACTION* (attachment 4)

The Authority contracts with the City Attorney for certain routine legal matters, and it also has retained the outside firm of Nossaman, Guthner, Knox and Elliott as general counsel specialized in transportation matters. The current contract will expire September 30, 2004. In August 2004, the Authority issued a request for proposals for general counsel professional services. Four firms submitted responsive bids, which included both a technical and cost component, by the proposal deadline. One out-of-town firm withdrew its bid because of geographic hardship. Oral interviews with the remaining three firms were conducted by a selection panel comprised of representatives from the Metropolitan Transportation Commission and the Authority. Based on the competitive selection process, the panel recommended award of the general legal counsel professional services to Nossaman, Guthner, Knox and Elliott. We are seeking a motion of support for the award of a three-year contract with two additional one-year extension options to Nossaman, Guthner, Knox and Elliott, in the amount of $120,000 per year, to provide general legal counsel services, and authorization for the Executive Director to negotiate the non-monetary terms and conditions of the contract .

8. November/December Meeting Schedule - ACTION

The November and December CAC meetings have been combined into one meeting in previous years because of the holiday season. The November/December meetings have been typically held on the first Wednesday in December. However, December 1 (the first Wednesday) immediately follows Thanksgiving weekend so the CAC may wish to consider Wednesday, December 8 as a potential meeting date. We are seeking a CAC motion to combine the November and December meetings into one meeting in early December based on the availability of the CAC members.
