Recommend Approval of MUNI's Request for Allocation of $28,554,000 in Proposition K Funds for Construction of Metro East Maintenance Facility of the Third Street Light Rail Project – ACTION* (attachment 3) This item is a funding request for Metro East Maintenance Facility (MME) of the Third Street Light Rail Project. The overall cost of theMMEis budgeted at $129 million. MUNI has chosen to use the Construction Manager/ General Contractor (CM/GC)method for the MME. TheCM/GC contracting method was chosen to create additional contracting opportunities for small and disadvantaged businesses.The CM/GC has beenperforming outreach to local contractors to make them aware of these contracting opportunities. Under this contracting method, the CM/GC awards trade contracts as construction progresses. Because of this, the allocation of funds will be done as each set of trade packages is advertised. The CM/GC currently has $17.5 million in subcontracts underway, and has advertised an additional $83 million in subcontracts. The currentfunding need for the MME is $100.3 million, of which $71.7 million is being funded by other sources. This leaves a Prop K sales tax funding need of $28.554 million at this time.Over thenext few months we will be submittingincremental funding requests until the project is fully funded. We are seekinga recommendation to approve MUNI's request for allocation of $28,554,000 in PropositionK Funds for construction of Metro East Maintenance Facility of the Third Street Light Rail Project. 5. Recommend Approval of San Francisco's Project Priorities for Local Streets and Roads Shortfall Program STP Funding in the Amount of $5,346,000, as presented – ACTION* (attachment 4) On May 6, 2004, the Metropolitan Transportation Commission (MTC) issued a call for projects for federal Surface Transportation Program (STP) funds under the Local Streets and Roads Shortfall Program. The program is intended to fund pavement rehabilitation, preventive maintenance projects with a life span of 5 or more years, and non-pavement rehabilitation projects. MTC has designated a total of $5,346,000 in STP funds for San Francisco for the Local Streets and Roads Shortfall Program, with an annual programming target of $2,673,000 in both FY 2005/06 and FY 2006/07. As the Congestion Management Agency for San Francisco, the Authority is responsible for developing a list of San Francisco projects and submitting the project priorities to MTC by August 31, 2004. By our July 6, 2004 deadline, we received two project applications from the Department of Public Works (DPW), one for 16 th Street from Utah to Market and one for Valencia Street from Cesar Chavez to Market. Both projects meet the program eligibility requirements and the total amount requested exactly equals the amount of STP funds that are available for programming. Thus, we are recommending funding both projects as requested (see Attachment A). We are seeking a recommendation to approve San Francisco's project priorities for Local Streets and Roads Shortfall Program STP funding in the amount of $5,346,000, as presented. 6. Countywide Cost Allocation Plan (COWCAP) - ACTION* (attachment 5) The Authority has a policy adopted in 1993 and ratified in subsequent Strategic Plan Updates, which disallows reimbursements to City departments for citywide overhead costs assessed through the Countywide Cost Allocation Plan (COWCAP). COWCAP is intended to recover the costs of running City government. The Authority's policy is based on the tenet that a special purpose agency (Gov Code 131000) with a separate operating budget and revenues must remain separate from local government and should not have to pay for the administration of local government. This notwithstanding, given the current shortfall in the City's General Fund, and the potential impacts that this might have on City departments' ability to maintain the pace of implementation of Proposition K projects, the Authority Chairman has requested that we pursue a one-year, temporary suspension of the current policy up to a maximum $900,000 COWCAP expense, with the aim of ensuring the continued expeditious delivery of the Proposition K program.
